1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legal agreement between you ("User", "you") and Inceptyon Labs LLC ("we", "us", "our") regarding your use of the INCEPTŸON mobile application (the "App").

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

The App is intended for users aged 9 years and older.

• Ages 9-12: Must have parental or guardian consent to use the App.
• Ages 13+: May use the App independently, subject to these Terms.

If you are under 13, you must have your parent or guardian review and accept these Terms on your behalf.

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on devices that you own or control.

3.1 Restrictions

You may NOT:

• Modify, reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Use the App for any commercial purpose without our written consent
• Distribute, sell, rent, lease, or sublicense the App
• Use the App in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to the App's systems or networks
• Use automated tools (bots, scripts, macros) to manipulate game progress

4. Intellectual Property Rights

4.1 Ownership

The App, including all content, features, functionality, code, graphics, audio, text, and the "look and feel" of the App, is owned by Inceptyon Labs LLC and is protected by U.S. and international copyright, trademark, patent, trade secret, and other intellectual property laws.

4.2 Trademarks

The following are trademarks of Inceptyon Labs LLC:

• INCEPTŸON
• LPN Directive (Lifeform Preservation & Nurture Directive)
• The Parker Protocol
• The Architect
• Quantum Xenogenesis

You may not use these trademarks without our prior written permission.

4.3 Third-Party Content

The App includes educational content sourced from:

• NASA/JPL-Caltech (Public Domain)
• ESA/Hubble (CC-BY 4.0)
• Peer-reviewed scientific publications (fair use)

All third-party content is used in accordance with applicable licenses and is the property of their respective owners.

5. User Conduct

You agree to use the App in a manner consistent with all applicable laws and regulations. You will NOT:

• Use the App to harm, harass, or threaten others
• Upload or transmit viruses, malware, or other malicious code
• Interfere with or disrupt the App's operation
• Attempt to exploit bugs or glitches for unfair advantage
• Impersonate any person or entity
• Use the App for any unlawful purpose

6. User-Generated Content

The current version of INCEPTŸON (0.2.0) does not support user-generated content (UGC), such as chat, comments, or custom content uploads. All gameplay is single-player and offline.

If future versions introduce UGC features, we will update these Terms accordingly.

7. In-App Purchases (Future Feature)

7.1 Current Version

The current version of INCEPTŸON is completely free with no in-app purchases (IAP) or ads.

7.2 Future Versions

We may introduce optional in-app purchases in future updates for:

• Cosmetic items (species skins, habitat themes)
• Convenience features (time skips, offline boost extensions)
• Donation support (support development, unlock bonus content)

Important: All core gameplay content (species, moons, educational facts) will remain free. IAP will never be required to progress.

7.3 Payment Terms

If IAP are introduced:

• All payments are processed through Apple's App Store (iOS) or Google Play (Android)
• We do not store or process payment information directly
• All purchases are final and non-refundable, except as required by law
• Refund requests must be made through Apple or Google

8. Data Collection & Privacy

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. Key points:

• We collect zero personal data
• Game progress is stored locally on your device only
• Optional analytics (Sentry, Posthog) for users 13+ who opt-in
• COPPA compliant for children under 13

9. Disclaimers & Warranties

9.1 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Guarantees

We do not guarantee that:

• The App will be error-free, uninterrupted, or secure
• Defects will be corrected
• The App will meet your specific requirements
• Save data will not be lost or corrupted

9.3 Educational Content

While we strive for scientific accuracy in our educational content, we make no warranties that the information is complete, accurate, or up-to-date. The App is designed for entertainment and educational purposes, not as a substitute for formal education or professional scientific advice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INCEPTYON LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers
• Any bugs, viruses, or other harmful code
• Any errors or omissions in any content
• Loss of save game data

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE (12) MONTHS (WHICH, FOR THE CURRENT FREE VERSION, IS $0).

11. Indemnification

You agree to indemnify, defend, and hold harmless Inceptyon Labs LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your access to or use of the App
• Your violation of these Terms
• Your violation of any third-party rights

12. Termination

12.1 By You

You may terminate this agreement at any time by uninstalling the App and ceasing all use.

12.2 By Us

We reserve the right to suspend or terminate your access to the App at any time, without notice, for:

• Violation of these Terms
• Fraudulent, illegal, or harmful behavior
• Use of automated tools or cheating
• Any other reason at our sole discretion

12.3 Effect of Termination

Upon termination:

• Your license to use the App immediately ceases
• You must delete the App from all devices
• Sections 4 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), and 14 (Governing Law) survive termination

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting at inceptyon.io/terms or upon the next app update.

Your continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App.

14. Governing Law & Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], United States, without regard to its conflict of law provisions.

14.2 Jurisdiction

You agree that any legal action or proceeding arising out of or related to these Terms or the App shall be instituted exclusively in the state or federal courts located in Hillsborough County, Florida.

14.3 Arbitration (Optional)

For disputes under $10,000, you and we agree to resolve disputes through binding arbitration, except that either party may bring an action in small claims court.

14.4 Class Action Waiver

You agree to bring claims against us only in your individual capacity and not as a plaintiff or class member in any class or representative action.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Inceptyon Labs LLC regarding the App and supersede all prior agreements and understandings.
